Autopia Legal Information
- Autopia specialises in the sale of new and used vehicles. The specification of a vehicle may differ to that of other vehicles available in the UK.
- The UK registration date is not necessarily connected to the date of manufacture. You may not be the first registered keeper of the vehicle.
- Vehicles will be supplied with the balance of the manufacturer’s warranty, where available.
- Autopia will pass on all keys, manuals, service records and radio codes to the new keeper.
- The title of a vehicle does not become the customer’s until cleared and full funds have been received.
Deposits and Prepayments
- A deposit payment is required with every order so as to show the customer’s commitment to purchase the vehicle and Autopia’s commitment to supply the vehicle. Any payment made would have been negotiated between Autopia and the customer and is set out as a deposit or a holding fee. An Order Agreement is issued for a deposit or holding fee that is made.
- If the customer fails to settle the outstanding balance, without lawful reason, by the agreed date, Autopia will be entitled to treat the agreement as cancelled by the customer and offer the vehicle for re-sale and claim from the customer any reasonable losses suffered, which my include, but are not limited to, stocking charges, unrecoverable extras fitted to the vehicle, and any reduction in the value of the vehicle. Autopia will be entitled to use the deposit and any pre payment to reduce its reasonable losses. Any excess will be returned to the customer and any shortfall will be paid by the customer. If Autopia fail to deliver the vehicle by the agreed date, Autopia shall return the deposit, and any pre payment, to the customer and shall not be held liable by the customer for any reasonable losses the customer may suffer. Please note that Autopia will make every effort to guarantee a vehicle’s delivery. Autopia will ensure that any information relating to a vehicle is passed on to the customer as and when information is received by Autopia.
- Provisional Orders (pre-stock / pre-build) – this relates to where Autopia have agreed to purchase a vehicle so as to sell to a customer. In this event, Autopia will make every reasonable effort to locate such a vehicle for the price and specification provisionally agreed.
- If after a reasonable amount of time, this proves unsuccessful, either Autopia or the customer may cancel the provisional agreement, in which case neither party will make a claim against the other and Autopia will refund any deposit or pre payment.

Call Centre/Internet Deposits
- Autopia do not undertake distance sales whether via telephone / internet or any other means.
- Where a customer sees a vehicle on the internet or in any other advertisement placed by Autopia, they can pay a deposit over the telephone by credit or debit card or via telegraphic transfer (please note that credit card transactions are subject to a handling fee – this does not apply to debit card transactions).
- Such a deposit, where it is accepted, will become a holding deposit. Autopia will hold the vehicle for an agreed period for the customer to inspect.
- The taking of such a deposit does not bind Autopia or the customer and is refundable should the vehicle not be sold to that customer.
- Nothing in this section shall apply to customers who visit Autopia’s premises and subsequently place orders, over the telephone / internet, a vehicle, which they have previously viewed.
- Once the customer has visited our premises and decided to purchase a vehicle (or any other vehicle) then they will be asked to sign an Order Agreement which will incorporate its own Terms and Conditions for that particular sale. Subsequently once an order agreement has been signed, its Terms and Conditions will overpower any other Terms and Conditions on our website / adverts.
- If we proceed with a vehicle sale to our customer, then their holding deposit will become non refundable.

Part Exchange
- Any part exchange allowance agreed with a customer is either based upon the customer’s description of the vehicle to Autopia or upon its inspection by Autopia.
- In the event of subsequent damage to the vehicle, fair wear and tear expected, or if the customer knowingly gives incorrect information concerning the vehicle or has concealed a defect in the vehicle which Autopia relied upon, Autopia may decline to take the vehicle, in which case Autopia will try to agree with the customer a new allowance. If no agreement can be reached, the customer shall either pay the full price, or Autopia will be entitled to treat the agreement as cancelled by the customer. The customer will be liable to any cost / losses incurred by Autopia.
- When a part exchange is completed, a short agreement is raised so as to document this.
Warranty
- The vehicle will be supplied with the balance of the manufacturer’s warranty where available. Manufacturer’s warranties for imported vehicles may vary from those for vehicles manufactured in the UK.
- Any claim by the customer based upon defects in the quality or condition of the vehicle shall be notified to Autopia within a reasonable 7 days from the date of delivery.
